Permission to sublet

If you want to sublet room(s) in your rent flat or sublet your rent flat for a limited period of time you need the permission of the landlord owning the property.

If this permission is not yet given in your rental contract:

You are entitled by the law to sublet (parts of) your flat as long as this does not mean it is used for purposes other than intended or becomes overcrowded. Your landlord is not allowed to object to the permission to sublet if you want your flat be taken care of while you reside elsewhere due to careers reasons (LG Berlin, AZ:67S 297/93). This is only the case, however, if not the flat as a whole is sublet. Courts see periods of 12 months as a limited period of time while four years are assumed to indicate a change of abode.

How to present your flat
• no persons within rooms
• take pictures from different perspectives in order to give people an impression of the room. Do not photograph specific items of furniture.
• try to create a well-lit situation. Don´t photograph against the glare of a window, combine daylight and artificial light
• if you offer a single room: please document kitchen, bathroom (and rooms to share) as well


Contract

Always make contracts in written form. Of course most sub-tenants are decent and solvent people, nevertheless don´t do without a written contract. A form for a rental contract – worked out by lawyers – can be provided by us if you want to let accommodation via our service. Just give us a call and we will send you standard contracts.

Handover certificate

A detailed inventory list can be downloaded here. A handover certificate should be part of any rental relationship. In cases of conflict or damage objective regulation is then possible.

Prolongation

Prolongations should be taken down in written form. If your sub-tenant likes it with you and wants to stay longer, this is a good thing. In addition the written form means, both parties have a binding contract for the prolongation.

In case of damage

While you are absent your household and personal effects insurance will cover expenses caused by storm, fire, water or theft. If your sub-tenant damages the room(s) her/his liability insurance will pay for it. However, if your sub-tenant damages any items provided by you for her/his use like carpets etc. no insurance will pay. The sub-tenant must then pay for her-/himself. To avoid complications it is best to make sure important and expensive things are safely stored away.
